MEMBERSHIP TERMS
AND CONDITIONS
By accessing a NUsport Managed Facility or participating in any NUsport Program You (on Your own behalf or as guardian of Your child) acknowledge and agree that these terms and conditions together with any application or membership form to which these terms are referred or attached make up a binding agreement between You and NUsport.
This Agreement is accepted by either signing the application or membership form, paying the relevant membership or program fees or accessing any NUsport Managed Facility or participating in any NUsport Program after receiving notice of this Agreement.
RISK WARNING: You or Your child's participation in any NUsport Managed Facility is a recreational activity which involves a risk of physical harm, injury or damage to You or Your child. Physical harm that might arise from You or Your child's participation in a NUsport Program or use of any NUsport Managed Facility includes, but is not limited to, joint and muscle sprains and strains, bruising, concussion, cuts and abrasions, dehydration, dental damage, joint injuries, nose injuries, stress fractures and bone/joint/muscle breakages and strains. The degree of risk and extent and type of physical harm, injury or damage may vary depending on the nature of the NUsport Program or NUsport Managed Facility.
Declaration
You acknowledge and agree that by visiting NUsport Managed Facilities or participating in NUsport Programs that you are complying with NSW Government Public Health Orders. You accept NUsport’s terms and conditions and will abide by NUsport Safety Standards.
Newcastle University Sport (NUsport)
NUsport is a not-for-profit entity which exists to initiate, develop, operate and maintain sporting recreational services, facilities and relationships for and in support of the University and its communities. NUsport is governed by a Board of Directors who are responsible for the performance of NUsport and defines the organisational purpose, sets the long-term strategic direction; and oversees strategic implementation.
- NUsport will collect and use Your personal information in accordance with the NUsport Privacy Policy, details of which can be found on the Website or by contacting a NUsport Managed Facility.
- NUsport may vary these Terms & Conditions at any time and without notice to You. This includes any fees or prices referred to in any way connected with this agreement. Varied Terms & Conditions will be placed on the Website at NUsport's earliest convenience.
- Website Terms & Conditions for use - When using the NUsport Website (Website), you agree to accept and comply with the terms & conditions of use.

NUsport from time to time will share information with the University of Newcastle. Information will only be shared if You indicate through the enrolment process that you are a student or an alumnus of the University of Newcastle. The information shared is limited to: student number, membership type, first name, last name, date of birth, graduation status, name at graduation and most recent degree.
- University Student – applicable to University of Newcastle Students upon proof of current University enrolment. Your Student status will be periodically checked with the University of Newcastle and if at any time your eligibility changes, Your membership rate will be changed in accordance with these terms and conditions.
- Concession – applicable to University of Newcastle Staff (Full time, Part time, Conjoint, Casual) upon proof of employment. Other Concessions include University of Newcastle Graduates, eligible Corporate Companies, those under the age of 18 or proof of student, pension or disability concession, subject always to provision of adequate evidence supporting that Concession (in the absolute discretion of NUsport). Persons aged 18 and over are considered a legal adult and must purchase an individual membership.Restrictions are placed on facility usage for children aged 0 - 17 years. Please refer to the NUsport Kids in Gyms Guidelines for an outline of facility and program use.
- Full Fee - applicable to all members of the community (aged 18 years and above) without concessions.
- Associate NUsport Members – comprises of University of Newcastle Graduates, External, Corporate, Special as defined by NUsport Constitution. Membership under this category is valid 12 months from 1 March each year.
- Alumni – applicable to graduates of the University of Newcastle. Your details collected at the time of enrolment include full name at graduations, most recent University of Newcastle degree and Your University of Newcastle graduate status. Your details will be periodically shared with the University of Newcastle including the office of Alumni and Philanthropy.
- Mates Rates - Eligibility is determined by NUsport at its sole discretion. Refer to clause 7.6.
- New Membership - means a membership purchase when no membership agreement has been held in the past 12 month period.
- NUsport Membership – means paid access to NUsport managed facilities, NUsport At The Forum Sports & Aquatic Centre, NUsport At The Forum Health & Wellness Centre and the Ourimbah Pop-Up gym.
- University Residential Student Membership 2024 – applicable to University of Newcastle Students living in residential accommodation in 2024. Your residential status will be periodically checked with the University of Newcastle and if at any time your eligibility changes, Your membership will be cancelled.
- NUsport Swim Academy Squad Membership - means paid access into The NUsport Swim Academy Squad Program sessions.
- Ourimbah Pop Up Gym - means a NUsport managed fitness facility on the University of Newcastle Ourimbah Campus. Access is through paid membership (Ourimbah Pop Up Gym) or Fitness Passport. Exclusive access for University of Newcastle Staff and Students or TAFE Staff and Students with a Fitness Passport membership.
- NUsport Managed Facilities means any sporting, recreation, aquatic or similar facility owned or operated by or on behalf of NUsport from time to time.
- NUsport Programs means any sporting, recreation, fitness, fitness programs, aquatic, lifestyle, nutrition or similar training, online delivery, instructional videos / workouts, workshops and education programs offered or presented by or on behalf of NUsport from time to time.
Membership to NUsport
You may apply to become a member of NUsport:
- To access and use NUsport Managed Facilities, including membership to NUsport and the Ourimbah Pop Up Gym.
- To access and participate in NUsport Programs, including NUsport Affiliated Sporting Clubs.
You must make an application for membership by completing and submitting a membership form (which can be found on the Website or the information counter at any NUsport Managed Facility). You must ensure that you provide all relevant supporting information when submitting your application. A failure to supply any required information or an incomplete application may result in the application being delayed or refused.
Without limiting the preceding paragraph, NUsport may refuse Your application for Membership if:
- You fail to properly complete the application for Membership;
- NUsport determines, in NUsport's sole opinion, that You or Your child are in any way a threat to the health, safety or wellbeing to any NUsport patron, employee, agent or contractor; or
- You fail to comply with any other reasonable requirements of NUsport.
Unless otherwise stated in this Agreement, all applications must be accompanied by payment in full of the corresponding fee. All current fees are available on the Website.
Fees can be paid:
- Upfront Paid in Full (PIF); or

Ongoing Direct Debit (Direct Debit Option) by equal fortnightly instalments, payable in advance over the Initial Commitment Period (being either 12 month, 4 month, 3 month, 6 week, 28-day term, 14 days); or
- Online via the Website and/or member portal.
You are solely responsible for effecting and managing Your fee payments (irrespective of which payment method you elect).
NUsport reserves in its absolute discretion the right to authorise or refuse refunds and/or deny entry to any NUsport Managed Facility or participation in any NUsport Program for any purchases made fraudulently.
NUsport engages Ezypay to manage payments for the Direct Debit Options. If You elect to pay your Membership using the Direct Debit Option, You must agree to the Ezypay Terms & Conditions which can be found at www.ezypay.com.au. You must ensure that you review and understand those terms and conditions at the commencement of this Agreement and from time to time. The nominated Direct Debit bank account must be an Australian Bank Account which has direct debit access. Please check with your bank if you are unsure. Any failed direct debits will incur a dishonour fee invoked by Ezypay. NUsport will attempt to debit You no more than two times where a failed payment occurs and will not be liable for any fees or other costs that You may incur as a result of any failed payment or attempt to process a direct debit payment by or on behalf of NUsport.
Direct Debit fees can be paid up to three months in advance in person or by contacting a NUsport managed facility. Advance payment of fees will be subject to clause 2.5 of this agreement.
The Direct Debit Options will continue beyond the Initial Commitment Period, on a fortnightly / monthly (in line with your membership agreement) basis unless expressly cancelled by You in accordance with clause 2.4 of this Agreement. The fortnightly / monthly (in line with your membership agreement) Direct Debit amount will align with the applicable membership fee at that time. This may result in an increase to your Direct Debit amount after the Initial Commitment Period. We will notify you with a minimum 14 days notice of any change to your membership fee and the date from which the change will apply. Notification will be in writing to the supplied email address.
If You fail to make payment of any amount owing to NUsport in accordance with this Agreement, in addition to and without prejudice to any other rights that NUsport has under this Agreement or at law, Your access to NUsport Managed Facilities and participation in NUsport Programs will be suspended until such time as full payment is made. If you continue to incur outstanding payments, NUsport has the right to cancel your membership and refuse you access to Direct Debit membership options in the future.
You must keep NUsport informed of any changes to Your address, email, contact details, bank account/credit card details (if applicable) and any other information relevant to Your Membership, use of NUsport Managed Facilities or participation in NUsport Programs. You can update your personal details through your online member portal at any time.
Memberships subject to the Direct Debit Options may be cancelled by completing and submitting to NUsport the cancellation form on the Website.
- All cancellations require a 14 day notice period.
- All cancellations will be liable for any fees due which fall within the 14 day notice period.
- In respect of Direct Debit Memberships, a $100.00 cancellation fee also applies for memberships that are cancelled during the Initial Commitment Period.
- In respect of cancellation of Paid in Full memberships or advanced payments for Direct Debit memberships, no refunds will be provided.
Cancellations will not be accepted verbally.
Your membership cancellation will not be complete until authorised by NUsport Management and you have received written confirmation (outside of automated website response). It is the responsibility of the member to follow up any cancellation request. No refunds will be approved without proof of this confirmation. Cancellation requests for memberships on Time Freeze will not be actioned until the Time Freeze has ceased and any minimum term requirement has been met.
IMPORTANT: NUsport may immediately suspend and/or terminate a Membership at any time if NUsport determines, in its absolute discretion, that You have failed to comply with these Terms & Conditions or otherwise acted in a manner detrimental to NUsport, NUsport Managed Facilities, NUsport's patrons or other members, staff, employees, contractors or agents. Unless expressly agreed otherwise, in the event Your Membership is suspended or terminated, NUsport is not obliged to refund any fees paid by You.
All New Memberships, of three (3) months or more, are subject to a seven (7) day cooling-off period. During the cooling off period, You may cancel Your New Membership in the manner detailed at Clause 2.4 without penalty, less an administration charge (in accordance with the National Fitness Industry Code of Practice). Your use of NUsport Managed Facilities or participation in NUsport Programs during the cooling-off period will be subject to the applicable casual rate and will also be deducted from any refund due to You.
You can transfer your Membership of 12 months Paid In Full or Direct Debit Option to a person nominated by You within the Initial Commitment Period. Both parties need to be present at a NUsport Managed Facility to transfer the Membership. An administration fee will be payable by You or the incoming member at the time the Membership is transferred. The incoming member must meet the required membership eligibility and will be bound by the Terms & Conditions applicable to that membership for the remaining term duration. Membership eligibility, such as proof of concession or student enrolment, will be required.
IMPORTANT: Your membership transfer will not be complete until the required paperwork has been authorised by NUsport Management and you have received written confirmation. It is the responsibility of the member to follow up the transfer request. No refunds will be approved without proof of this confirmation.
Memberships entitled to the Time Freeze benefit may be suspended by completing the Time Freeze Request option through the Member Portal or NUsport website.
NUsport may (in its absolute discretion) agree to suspend the operation of a Membership (called a 'Time Freeze') for Memberships of 12 months Paid In Full or Direct Debit (12 month Initial Commitment Period) Option for travel, medical or other personal circumstances. In such circumstances, the initial commitment period of Your membership will be extended by the duration of the 'Time Freeze' granted.
- Time Freeze may be issued for a minimum of 2 weeks and a maximum of 4 weeks per 12 month membership cycle.
- A Time Freeze is not an automatic right available to You and the maximum periods of Time Freeze do not accumulate over any 12 month membership cycle. It is at the discretion of the Executive NUsport Management to approve Time Freeze outside of clause 2.7(1) and 2.7(2).
After the completion of the Initial Commitment Period on all Ongoing Direct Debit memberships, including the 6 week flexi membership, ‘Time Freeze’ is available at the discretion of NUsport.
To be eligible for Time Freeze You:
- Must have a valid financial membership held in Your name;
- Must complete and submit a "Time Freeze Request" form found on the Website at least 14 days prior to the commencement of the Time Freeze period or actioned through the Member Portal;
- May be required to provide NUsport with supporting documentation.
In the event NUsport is required to close a NUsport Managed Facility, outside normal trading hours, for more than seven days in a row, Time Freeze may be available to affected members upon request. This request can be made by completing and submitting a Time Freeze Request form.
Multi Visit Packages
- All Multi Visit Packages must be paid in full (PIF) at the point of purchase.
- No refunds apply to Multi Visit Packages.
- Unused credits will be forfeited at the date of expiry.
- Multi Visit Packages cannot be used between multiple people.
- Timestop or any extension of expiry dates is not available on any Multi Visit Packages.
20 Visit Swim Package
- 20 Visit Swim Package refers to the purchase of 18 credits and receive two credits free, totalling 20 credits.
- Valid for 12 months from date of purchase or until the credits have been used, whichever comes first.
- 20 Visit Swim Package only valid at NUsport, University for general lap swimming.
5 Visit NUsport Package
- Valid for 6 months from date of purchase or until the credits have been used, whichever comes first.
- 5 Visit NUsport package is valid at NUsport Health & Wellness Centre, Harbourside and NUsport Sports & Aquatic Centre, University.
NUsport Programs
NUsport reserves the right to modify, re-schedule or cancel any NUsport Program. NUsport will provide full refunds for cancellations in respect of Short Course Programs, including Holiday Programs, where these courses have been cancelled by NUsport. Any request for a refund must be made in writing to NUsport Management.
Group fitness timetables are subject to change without notice. All timetables and schedules for NUsport Programs can be found on the Website. NUsport will endeavour to keep the Website updated which will serve as reasonable notification to You of any changes to timetables.
NUsport from time to time will host or participate in organised events. All events are classified as a NUsport Program.
Declaration: You as the participant acknowledge that you are in a fit and healthy state to take part in NUsport delivered programs each and every time you partake. By participating in NUsport Programs you agree to NUsport’s Terms and Conditions.
Financial reimbursement will not be made available in the event of the above strikes being incurred. |
- NUsport may from time to time promote the availability of Personal Training services within NUsport Managed Facilities or as part of any NUsport Program and make an offer to introduce its Members to personal trainers.
- Unless otherwise expressly stated to the contrary, any Personal Training services are offered and undertaken by independent trainers not employed or engaged by NUsport.
- Any engagement of any personal trainer will be at the Your sole cost in addition to Your membership fees, and may be subject to additional terms and conditions governing the provision of those personal training services. You must ensure that you have read and understood any additional terms and conditions governing the provision of personal training services.
- Irrespective of any additional terms and conditions governing the provision of personal training services, You and Your personal trainer must at all times comply with this Agreement whilst ever You are attending any NUsport Managed Facility or participating in any NUsport Program, even where such attendance or participation is undertaken in conjunction with any personal training services, and to the extent of any inconsistency between this Agreement and any additional terms governing the provision of the personal training services, this Agreement applies.
- NUsport reserves the right in its absolute discretion to refuse entry or eject You or Your personal trainer from any NUsport Managed Facility where either of You or Your personal trainer are not complying with this Agreement.
- NUsport will at no time be liable for any cost, loss, damage, injury or expense (Claim) arising in any way as a direct or indirect result of Your engagement of a personal trainer or Your participation in or receipt of personal training services in or about any NUsport Managed Facility or as part of any NUsport Program including without limitation where NUsport refuses entry or expels You or Your personal trainer pursuant to the preceding subclause, and You release NUsport absolutely and hold it harmless from any liability arising from any such Claim, except only to the extent that such Claim is caused directly by the negligence of NUsport.
NUsport delivers Programs to support special populations from time to time. These special population programs are developed by NUsport around the needs of and in conjunction with individuals or groups. Conditions pertaining to these programs are developed per request and detailed in individual booking confirmations.
NUsport reserves the right to restrict access to, or participation in, any special population services or program in its absolute discretion.
Any booking or participation fees or costs for the special population services or programs will be payable by You in addition to Your membership fees. Those costs will be confirmed by NUsport, and will be payable by You in full, prior to commencement of the special population service or program.
NUsport delivers Allied Health Services inclusive of Exercise Physiology and Dietitian.
Payment of Fees
Allied Health Services are to be paid for Upfront and in full.
Cancellations
- If you are unable to attend a session, you must provide 24 hours notice by contacting your trainer or a NUsport Member Relations Consultant at the relevant NUsport Managed Facility. Any notice of less than 24 hours will result in forfeiture of payment for the full session.
- To be eligible for a replacement session, you must show a medical certificate.
NUsport Programs can be delivered online, including but not limited to online fitness classes and stay active workout videos, through NUsport’s website, The NUsport App, Social Media channels or other online platforms.
You acknowledge and agree that:
- You must not participate in NUsport Programs if such use or participation will adversely affect your physical or mental wellbeing;
- NUsport is in no way responsible for determining whether you are physically or mentally able to participate in NUsport Programs;
- You have made the necessary enquiries and received the necessary medical advice to ensure Your participation in NUsport Programs will not in any way whatsoever adversely affect Your health or wellbeing (physical or other);
- You will participate in NUsport Programs at Your own risk;
- You will participant in NUsport Programs within your physical limits, in a safe and suitable environment.
All NUsport online content, including but not limited to instructional videos, are for personal non-commercial use only. NUsport reserves the right to modify, re-schedule, remove or cancel any online NUsport Program without notice.
It is advised that the participation of children in these online classes is per the Kids in Gyms Guidelines.
Virtual Group NUsport classes may be recorded for future use and made available on NUsport’s website.
NUsport Programs can be delivered outdoors, including but not limited to Small Group training, Boot Camps and Group Fitness classes and NUsport Events.
Declaration: You as the participant acknowledge that you are in a fit and healthy state to take part in NUsport delivered programs each and every time you partake. By participating in NUsport Outdoor Training / Events you agree to the following Terms and Conditions.
You acknowledge and agree that:
- You must not participate in NUsport Programs if such use or participation will adversely affect your physical or mental wellbeing;
- NUsport is in no way responsible for determining whether you are physically or mentally able to participate in NUsport Programs;
- You have made the necessary enquiries, completed the mandatory pre-screening medical questionnaire and received the necessary medical advice to ensure Your participation in NUsport Programs will not in any way whatsoever adversely affect Your health or wellbeing (physical or other);
- You will participate in NUsport Programs at Your own risk;
- By participating in Outdoor Training you are aware of the physical environment, including but not limited to heat and wet weather, and agree that they are suitable for use.
- You hereby release and indemnify NUsport (and its employees, agents and contractors) from and against any claims, loss, liability, damage (whether of a direct, indirect or consequential nature) howsoever caused arising out of or in connection with Outdoor Training or NUsport Events.
- Booking and Payment (where applicable):
- to participate in Outdoor Training You must book online in advance of session. Confirmation of space in session conditional on successful pre-payment where applicable.
- Sessions may be cancelled due to wet weather at the discretion of NUsport Staff.
- Cancelled sessions will be credited for use at an alternate date and time where applicable.
- If You are unable to make your session, 24 hours notice is required to receive a credit for future use where applicable.
- A refund will only be provided with a supplied medical certificate where applicable.
- Limited places are available.
NUsport reserves the right to modify, re-schedule, remove or cancel any scheduled NUsport Program without notice.

IMPORTANT: NUsport may immediately suspend and / or terminate a Membership at any time if NUsport determines, in its absolute discretion, that You have failed to comply with these Terms & Conditions or otherwise acted in a manner detrimental to NUsport, NUsport Managed Facilities, NUsport's patrons or other members, staff, employees, contractors or agents. Unless expressly agreed otherwise, in the event Your Membership is suspended or terminated, NUsport is not obliged to refund any fees paid by You. |
- You will be able to suspend the operation of a Swim Academy Membership for travel, medical or other personal circumstances.
- A membership freeze may be applied for a minimum of one week and a maximum of 12 weeks for any Squad membership and a minimum of one week and a maximum of 4 weeks per school term for any Learn to Swim enrolment, if at least one week's notice has been provided in writing.
- Submit your 'Membership Freeze' through the Member Portal or by contacting ask@theforum.org.au
- A membership freeze cannot be applied for periods where Squad members are participating in Coach supported Swim Meets.
It is at the discretion of the Aquatics Manager to approve a membership freeze outside of sub-clause (4.7.C.2).
- If You have been drawn to play in a Sporting Competition in any part of a NUsport Managed Facility (which includes without limitation one off competition games, races, etc in addition to round robin and knock out galas and other competitions) and You wish to cancel this booking, You must provide NUsport with at least 24 hours notice by contacting a NUsport Member Relations Consultant at the relevant NUsport Managed Facility.
- Cancellations of less than 24 hours notice will incur a forfeit fee. This fee is to be paid on arrival at the next game/competition or on written demand made by NUsport, whichever occurs first.
- All applicable fees are to be paid in full prior to commencement of game.
- Fees are available on the Website and are subject to change in the discretion of NUsport.
If You are participating in Sports Competitions, You must comply with the Code of Conduct and any rules and regulations applicable to that Sports Competition. These are available to view on the Website.
Infringements of Sports Competitions Code of Conduct may result in You or Your team (depending on the nature of the infringement) being removed from the Sports Competition. In the event Your team is removed, fees will not be refunded.
- Booking requests must be submitted no later than six (6) weeks prior to booking commencement. This is to include a request of classes and venues required. A booking confirmation will follow once instructors and facilities have been confirmed subject to availability.
- Final numbers are required three (4) weeks before the confirmed booking commences. This list of participants must include any medical conditions and individual special needs that may apply to students.
- Instructor to participant ratios will be based on confirmed numbers provided to NUsport.
- You must provide NUsport with at least 21 days notice of any cancellation of school sport bookings (this includes individual sessions, facility hire and program bookings).
- Failure to provide 21 days notice (but not less than 14 days) will incur a cancellation fee of 25% of the program fee based on confirmed participant numbers. Notice of cancellation given less than 14 (but not less than 7) days before the booking will incur a cancellation fee of 50% of the program fee based on confirmed numbers. Notice of cancellation given less than 7 days before the booking will incur a cancellation fee of 75% of the program fee based on confirmed numbers.
- Payment of School Sport programs are processed in arrears via a monthly invoice, unless the booking confirmation states otherwise.
- For Group Fitness / Circuit / Splash Zone Activity Bookings: All schools will be invoiced for the minimum number of twenty (20) participants per session on a monthly basis. School Groups must then confirm weekly attendance numbers each week, which will be added to the monthly invoice. Failure to provide attendance numbers will result in the school being invoiced for the maximum number as confirmed 4 weeks prior to the school sport activity commencing.
- For Swim and Survive / Bronze Star Classes invoices will be generated based on the final numbers confirmed 4 weeks prior to booking commencement. There will be no adjustment to numbers on a week to week basis.
- Age restrictions for Splash Zone apply, 6 - 16 years inclusive.
- ALL children MUST complete a Swim Test in order to participate on the Splash Zone. This consists of completing a 15m swim in a recognisable stroke. The final decision will be made by the lifeguard on duty as to whether children have passed the swim test
- Children who do not pass the swim test will be permitted to have free pool entry to swim under parent/guardian supervision but will not be allowed on the Splash Zone.
- Parents / Guardians are to gather and wait at Main Reception / seated foyer area of NUsport, University. The Party Host will collect the party group within 5 minutes of the party start time. Under no circumstances are parents / guardians permitted to enter the aquatics area prior to this time unless arrangements have been made with the Venue Hire department in advance.
- Flotation devices are strictly prohibited for use on the Splash Zone as they are a safety hazard.
- Final numbers must be confirmed by the Thursday prior to the party.
- The cost for a Splash Zone party is $260.00 per party, for 10 participants, with additional children to pay $26 each up to the maximum of 20 participants.
- A parent / guardian is to be present at all times for the duration of parties. Parents and children are expected to adhere to NUsport rules and staff directions. Staff reserve the right to exclude participants from activities if they do not comply as requested.
- NUsport Managed Facilities are strictly alcohol free zones.
- Children participating in party activities will be issued with wrist bands by the Party Host. These are to be worn for the duration of the party. Any child not wearing a wrist band will not be allowed to participate in party activities.
- Party includes exclusive use of activity / equipment booked for the time specified. There is 75 minutes of facilitated activity on the Splash Zone and 45 minutes in the provided party space.
- All Party Space arrangements, such as decorations, catering and birthday cake, are not included in the party booking. Limited fridge space is available to store a birthday cake. All other food storage is the responsibility of the parent / guardians.
- Tables and chairs will be provided based on the number of confirmed participants.
- Party Space bookings have a strict time limit of 45 minutes and you must leave at your allocated finishing time. Your party group is welcome to utilise the grandstand and children can continue swimming in the public lane space.
- Full Payment is required prior to the commencement of the party.
- A $50.00 cleaning fee may be charged if a Party Space is left in a state that requires additional cleaning.
- Cancellations made within 24-72 hours’ notice will receive 50% back of party fee, Cancellations made with 4 – 21 days’ notice will receive 75% back of party fee. Cancellations made with more than 21 days’ notice will receive a full refund. No refunds will be given within the 24 hour notice period. A credit percentage will be considered, at the discretion of NUsport, for cancellations made within the 24 hour notice period due to positive COVID-19 infections within the host family unit.

- Operating hours:
- The facility will operate Monday to Friday 6am to 7pm only. The Facility will only operate during university semester periods. The facility is not open on public holidays, weekends or if the Ourimbah Campus is closed.
- Safety and Security
- Be vigilant
- You must be vigilant when entering and leaving the Ourimbah Pop Up Gym and be aware of your surroundings, for example, when exercising outside of staffed hours.
- Report any hazards or potential risks to University Security immediately on 02 4921 5888 and remove yourself from any potential danger.
- For first aid treatment outside of staffed hours, please call University Security on 02 4921 5888.
- Closed Circuit Television (CCTV)
- The Ourimbah Pop-Up Gym will have internal and external CCTV security cameras monitoring the open area of the facility (except in the bathrooms). The CCTV will operate in line with the University of Newcastle’s CCTV policy.
- The CCTV system is used for security purposes but does not guarantee against harm.
- Emergencies
- The Ourimbah Pop Up Gym has an emergency phone and duress button installed to alert university security for emergencies or safety concerns, for example, if you are, or feel, threatened, or need medical help.
- Emergency exit information is displayed within the facility.
- If you deliberately use emergency equipment (phone or duress button) inappropriately, you agree to pay for any cost, loss or damages incurred due to inappropriate use.
- If the emergency is life threatening always call Emergency Services (Police, Fire, Ambulance) on 000 first, otherwise call the safety and security services team on 02 4921 5888.
- Be vigilant
- Access and facility use:
- Your University of Newcastle student or staff identification card will be used as your access card for the Ourimbah Pop-Up Gym facility. Access activation for the Ourimbah Pop Up Gym can take up to 2 working days.
- To access the Ourimbah Pop Up Gym facility, You will need to scan your University of Newcastle student or staff identification card at the entry doors (through the provided Cardax system).
- If an entry scanner is available, all members, direct membership and Fitness Passport, are to scan their University of Newcastle student or staff identification card at the entry to register their attendance at the Ourimbah Pop Up Gym.
- Fitness Passport members must complete the applicable visitation sheet upon each entry.
- All members, direct membership and Fitness Passport, are to scan their University of Newcastle student or staff identification card at the entry to register their attendance at the Ourimbah Pop Up Gym.
- You must not let anyone else into the facility without the approval of NUsport staff or let anyone else use your University of Newcastle student or staff identification card for entry. If you breach this condition of entry, your membership and access to the facility may be suspended or cancelled. Pre-paid membership fees will not be refunded in this instance.
- Access to the Ourimbah Pop Up Gym is exclusive for members only, including direct membership and Fitness Passport members.
- Access is limited to 18+ years when accessing the facility outside of staffed hours. The NUsport Kids in Gyms Guidelines apply during staffed hours.
- You must take care of the facilities and equipment when using the Ourimbah Pop Up Gym. You must use the facilities and equipment If You are unsure of how to use the facilities and equipment You must seek advice from a NUsport staff member during the facilities staffed hours.
- The Ourimbah Pop-Up Gym offers virtual group fitness classes through LESMILLS. Classes are available On Demand or through a scheduled timetable (this will be displayed on a notice within the facility). On Demand delivery is available on a first come bases. You acknowledge and agree that:
- You will participate in virtual delivery group fitness at Your own risk;
- You must not participate in virtual delivery group fitness if such use or participation will adversely affect your physical or mental wellbeing;
- NUsport is in no way responsible for determining whether you are physically or mentally able to participate in virtual delivery group fitness;
- You have made the necessary enquiries and received the necessary medical advice to ensure Your participation in virtual delivery group fitness will not in any way whatsoever adversely affect Your health or wellbeing (physical or other);
- You will participate in virtual delivery group fitness within your physical limits, in a safe and suitable environment;
- If You do not understand the instructions given through the virtual delivery group fitness You must stop immediately;
- Do not participate in a virtual delivery group fitness program if you are not present at the beginning of the session.
- Membership:
- Access to the Ourimbah Pop Up Gym is through paid direct membership ($13.90 per fortnight) or a valid Fitness Passport card.
- 14 Days FREE is applied to all direct memberships to the Ourimbah Pop Up Gym. A pro-rata fee is payable upfront for alignment with the direct debit schedule. The first fortnightly direct debit fee is waived.
- The Ourimbah Pop-Up Gym membership has an initial commitment period of 42 days (inclusive of the 14 Days FREE period).
- Promotion - Free Access:
- From time to time, NUsport may run a promotion allowing free access into the Ourimbah Pop Up Gym.
- Free access will be granted to University of Newcastle Staff and Students or TAFE Staff and Students who hold a Fitness Passport membership.

- To gain free access to the Ourimbah Pop Up Gym, the applicable promotional membership must be redeemed.
- Free access period will be outlined in NUsport’s terms and conditions, Promotions and Campaigns.
- Age restrictions for the Sports Holiday Program apply, 5 - 12 years inclusive.
- Parents, guardians, or carers must accompany their child(ren) into the venue and sign them in and out of the Holiday Sports Program during the designated drop-off times of 8:30am to 9:30am and pick-up times of 4:00pm to 5:00pm.
- Parents, guardians, or carers of children participating in the Holiday Sports Program must read and agree to the NUsport Fair Play Guidelines with their child(ren).
- Parents, guardians, or carers must inform NUsport staff of any conditions impacting the child’ safety or ability to participant, and or any activities that the child should avoid.
- A child will not be released from NUsport's care if the parent, guardian, or carer picking up the child is not listed through the registration check in procedure. ID may be requested.
- Children who remain after the 5:00pm collection time may be charged a late fee due to staffing requirements.
- Sports Holiday Program activities will occur at a NUsport managed facility.
- All participants in the Sports Holiday Program must complete a swim test to participate in the Splash Zone activity. The test requires swimming 15 metres using a recognisable stroke under the supervision of a lifeguard. The lifeguard on duty will make the final decision on whether a child has passed the swim test.
- Children who do not pass the swim test will receive a highlighted wrist band for easy identification for lifeguards and Sports Holiday Program Supervisors and free play in the shallow end of the pool will be offered at the discretion of the lifeguard.
- Children must bring appropriate clothing to the program. This includes hat, enclosed shoes, suitable clothing for sporting activities, sunscreen and recognised swimwear. Any child attending the Sports Holiday Program that does not have the appropriate headwear, clothing or footwear will not be able to participate in the program's activities.
- Activities are designed for children of all abilities. Modifications will be made as needed to support each child to participate.
- Fees must be paid at the time of booking; In person or Online via the Website and/or member portal.
- All bookings are to be made in advance; no bookings will be accepted on the day of the Sports Holiday Program.
- Unauthorised photography is prohibited.
- No Refunds will be given for Sports Holiday Program booking. At the discretion of NUsport, credits may be available for use in future Sports Holiday Programs.
- NUsport is not responsible for lost or stolen items.
Hiring of NUsport Facilities / Programs and Services
- You must provide NUsport with at least 48 hours notice of any cancellations or modifications to bookings in respect of hiring of a NUsport Managed Facility to be eligible to receive a full refund of the amount paid in respect to that booking. This notification must be received in writing.
- If You fail to attend a booking and do not provide 24 hours notice of the cancellation or modification, You will incur a cancellation fee of up to 100% of the hire fee (determined in the absolute discretion of NUsport) for the following facilities; Indoor Courts, Studios, Squash Courts, Aquatic Lane Hire, Oval Hire, High Performance Gym and Climbing Wall.
- You must apply to NUsport in writing to hire the Hire Equipment. NUsport may refuse any application for hire if the purpose for which You wish to hire the Hire Equipment is, in NUsport's absolute discretion, inappropriate or unsuitable in anyway whatsoever.
- You will be solely responsible for the supervision, control and behaviour of your officers, employees, agents, players and spectators while using the Hire Equipment.
- NUsport will consider its programs and activities when confirming any hire request. Specific conditions may apply to any hiring confirmation. It is Your responsibility to understand and adhere to these specific conditions.
- You acknowledge and agree that:
- Before hiring the Hire Equipment You inspected the Hire Equipment and are satisfied that it is fit for the purpose for which You are hiring;
- Neither NUsport nor the University warrants that the Hire Equipment is fit for the hiring purpose;
- You must use the Hire Equipment in a safe and proper manner at all times and will comply with any directions given by NUsport or University staff;
- You must ensure that any anti-discrimination and anti-vilification policies of the University and NUsport are complied with at all times; and
- You must not use the Hire Equipment in a way that may bring the University or NUsport into disrepute.
- NUsport Managed Facilities are alcohol free zones and You must ensure that no alcohol is consumed in these areas during Your use. Where expressly authorised in writing by NUsport, the supply or consumption of alcohol by You must be undertaken under the guidelines detailed in the NSW Responsible Service of Alcohol policy and You must provide NUsport with a copy of the relevant functions licence before a booking is made for a function at which alcohol is proposed to be provided. You acknowledge that NUsport Managed Facilities are glass free zones and will ensure that no glass items are taken onto or into any part of NUsport Managed Facilities. For the avoidance of doubt, NUsport does not hold a liquor licence and will not be responsible for ensuring you comply with all relevant legislation, regulations and guidelines in respect to the sale or supply of alcohol.
- You release NUsport from any Claim suffered or incurred by You as a direct or indirect result of your use of the Hire Equipment including without limitation your failure to obtain or comply with any liquor licence, permit or other approval of any relevant authority prior to operating Your event at a NUsport Managed Facility.
- You must leave or return the Hire Equipment in a clean and tidy condition. Failure to do so may result in additional fees for cleaning or cancellation of future bookings. With the exception of fair wear and tear, You must pay for the repair of any damage to the Hire Equipment or any NUsport Managed Facility (or fixtures, fittings, furnishings, equipment or other property in or on a NUsport Managed Facility) arising out of or in connection with Your hiring. If using a NUsport Managed Facility, all warm ups, agility, speed and fitness must be undertaken outside the marked playing field.
- The Hirer will be solely responsible to communicate scheduled facility closures to its officers, employees, agents and players. Where the Hirer fails to communicate scheduled facility closures as advised by NUsport or as noted on The NUsport website www.nusport.org.au and utilise NUsport facilities during closures an additional charge of $300.00 (ex GST) per infringement will be issued.
- NUsport reserves the right to close ovals at any time before or during the booked period. The Hirer is required to comply with any decision made or direction given by NUsport. If it has rained overnight or it is raining during the morning of any scheduled use, it is the Hirer's responsibility to check with NUsport or visit The NUsport's website to ascertain availability of ovals.
- Other than Assistance Animals, You must not allow any animal to be brought onto NUsport Managed Facilities.
- You must not bring or allow any person to bring into NUsport Managed Facilities any explosive or flammable liquids, corrosive chemicals, dangerous goods or other like hazardous substances.
- You will ensure that all members of Your booking wear appropriate footwear in accordance with safety requirements at all times. Enclosed, non-marking footwear is required in the Stadium Court, Auchmuty Court, Studio 1, Studio 2, High Performance Training Zone, Meeting Rooms, Gymnasium, Climbing Wall and Squash courts. You acknowledge that football boots are not to be worn indoors of any NUsport Managed Facility.
- All keys (for access to Hire Equipment) are to be signed our and signed in the appropriate register and generally a deposit is taken. Hirers are not permitted to access storage areas without appropriate authority. Keys cannot be collected more than 15 minutes before commencement of the confirmed booking time. Keys must be returned within 15 minutes of the conclusion of the confirmed booking time. If the keys are not returned within these specified times, additional charges will apply.
- If You wish to cancel the delivery of NUsport Programs at locations other than a NUsport Managed Facility, You must provide NUsport with no less than 14 days notice. Cancellation notice of less than 14 days (but more than 1 week) of the booking will incur an administration fee equivalent to 50% of the booking fee. Notice of cancellation given less than a week before the booking will incur a fee equivalent to 100% of the booking fee.
- For bookings relating to online delivery, You must provide NUsport with no less than 7 days notice to make booking modifications. If You wish to cancel the booking, You must provide NUsport with no less than 48 hours notice. Cancellation notice of less than 48 hours will incur a fee equivalent to 100% of the booking fee.
You may hire equipment from NUsport if NUsport agrees (and subject to availability) only if You:
- Provide NUsport with the information/details required by NUsport;
- Pay the applicable fee as and when required by NUsport; and
- Where requested by NUsport, pay a security deposit or provide a suitable form of identification as requested by NUsport;
- Agree to meet all reasonable replacement costs if the hired equipment is not returned to NUsport on the date specified by NUsport and in the same condition the hire equipment is in at the time of hiring. If You have paid a security deposit, You agree that these costs can be deducted from the security deposit. You will be liable for any shortfall. Forum members who do not return equipment from their Equipment Hire Membership (Pump Pack) will have $50 direct debited from their nominated account.
- Equipment Hire Memberships (Pump and Functional Packs) - comply with clause 2.2 Payment for Fees;
You acknowledge and agree that:
- Before hiring the Hire Equipment You inspected the Hire Equipment and are satisfied that it is fit for the purpose for which You are hiring;
- Neither NUsport nor the University warrants that the Hire Equipment is fit for the hiring purpose;
- You must use the Hire Equipment in a safe and proper manner at all times and will comply with NUsport’s terms and conditions;
- You must not use the Hire Equipment in a way that may bring the University or NUsport into disrepute;
- You will use equipment hired from NUsport at Your own risk;
- Equipment Hire Memberships (Pump and Functional Packs) are valid for the temporary closure period of The Forum Sports & Aquatic Centre, University and The Forum Health & Wellness Centre, Harbourside. All equipment must be returned to The NUsport Sports & Aquatic Centre by a date set by NUsport, confirmed via email.
- Equipment Hire Memberships (Pump and Functional Packs) have access to the NUsport Online membership at no additional cost.
General

You must present Your Membership card to gain entry into NUsport Managed Facilities. If another person attempts to use Your card, that person will be refused entry into NUsport Managed Facilities. Your card will be retained by NUsport and the person attempting to use Your card will be questioned. Staff will notify You that Your card has been used fraudulently. If it is found that You voluntarily gave your card to a person for the purposes of fraudulently gaining entry to NUsport Managed Facilities, Your Membership will be cancelled without refund. All members over the age of 14 years must have their photograph taken for security purposes, to be held in NUsport's database. No entry will be allowed into a NUsport Managed facility within 30 minutes of closing of that facility. You acknowledge and agree that:

- Be courteous and considerate to your fellow lap swimmers. Select a lane to share with swimmers of similar ability and speed
- When sharing a lane, keep to the left of the lane at all times
- Do not stop in the middle of the lane
- Do not push off in front of a faster swimmer
- If passing, be aware of other swimmers in the lane
- If being passed, move to the far left and continue swimming to the end or briefly stop and give the passing swimmer more space
- Avoid moving across lanes in the middle of the pool, rather swim to the end and cross. If you must cross in the middle of the pool, check both directions before crossing
- When waiting at the end of the pool, move to the corner of the lane to allow other swimmers to complete the lap or turn
- If using equipment such as noodles or hand paddles, consider other swimmers in the lane and move if appropriate
- Pool Lifeguards monitor the lanes and may alter the configuration to accommodate bookings in which case you may be asked to move lanes. Please respect the Pool Lifeguards’ role in this instance
- Please respect our team members and follow their instruction.
- Be courteous and considerate to all gym users.
- If you have moved equipment, return to its original place after use.
- Allow others to work at your station between your sets.
- Rest is important but please be mindful of time spent on your phone between sets.
- Bring a towel and wipe down your equipment.
- If required, ask our staff for any assistance.
- Respect other people’s personal space.
- Be aware of your surroundings.
- If you notice a broken machine or piece of equipment, please let staff know so that we can have it serviced or replaced.
- Our gym is a shared space, don’t forget to share.
Your Membership;

- In respect to purchase of goods from the NUsport Retail Store, no refunds will be provided if You change your mind. Return and refund of faulty goods will be made in accordance with the Australian Consumer Law. You must return any goods for which you require an exchange to the NUsport Retail Store in original condition and with all tags intact within 7 days of purchase.
- In respect to sale items, no refunds or exchanges are permitted, subject always to any provisions of any relevant law that cannot be excluded.
University parking permits are available to eligible members to purchase for use at NUsport At The Forum Sports & Aquatic Centre. Permits are valid between 1 January – 31 December. The permit is valid in car parks 9, 12, 13 and 16 (as marked). The permit allows you to park for a maximum of 2 hours.
Staff and Students of the University of Newcastle are not permitted to purchase a parking permit for NUsport At The Forum Sports & Aquatic Centre.
Promotions and Campaigns
The following terms apply to the below special offers or trade promotions and, to the extent of any inconsistencies, the following terms will prevail. Promotional offers or prizes cannot be exchanged, transferred or redeemed for cash and will not be available to NUsport staff or families of NUsport staff. NUsport reserves the right to cancel or vary the terms of any special offer or trade promotion at anytime or refuse to award any special offer or prize to any person in NUsport's absolute discretion.
- Complimentary 1 day passes may be given to prospects and / or the general public at the discretion of NUsport and are limited to a maximum 2 passes per person in any 12 month period. The person redeeming the complimentary pass cannot have held a membership to The Forum in the previous 12 months.
- Complimentary Passes are not available with any other offer or discount and are not redeemable for cash, transferable or exchangeable. All rights reserved by NUsport.
- Use of Complimentary Passes is subject to these Terms & Conditions and any other conditions NUsport may impose (such as periods and dates available for redemption and use; and any blockout periods).
- Complimentary Passes can only be redeemed in person with a Member Relations Consultant at a NUsport Managed Facility. Guests must live locally and be 16 years and over. Guests may choose the NUsport Managed Facility at which they redeem the Complimentary Pass.
- Facility tour, photo ID and enrolment must be completed prior to use.
- The Trial Pass may be purchased or redeemed by the general public at the discretion of NUsport and are limited to one Trial per person in any 12 month period. The person redeeming the Trial Pass cannot have held a membership to NUsport in the previous 12 months.
- The Trial Pass will allow access to NUsport At The Forum Sports & Aquatic Centre and NUsport Health & Wellness Centre for 7 consecutive days. The Trial Pass cannot be broken up into individual days.
- The Trial Pass can only be activated in person by persons 16 years or older.
- The purchase or redemption of the Trial Passes is subject to these Terms and Conditions and any other NUsport may impose (such as periods and dates available for purchase and use; and any blockout periods).
- Any membership package / gift that has been received through a donation, sponsorship, prize, incentive or membership offer:
- must be redeemed within the time frame stated on the voucher, flyer or offer.
- is not exchangeable, refundable or redeemable for cash.
- has no additional benefits included such as Timestop or upgrades.
- cannot be transferred to another party.
- Winner may be announced via NUsport’s media channels.
If a financial membership is purchased in conjunction with a complimentary membership offer, the complimentary membership must be redeemed first, followed by the financial membership.
2. All existing members must complete the initial term of their current membership before the new complimentary membership can commence.
All financial NUsport members, have access to a number of inclusions within their membership. NUsport reserves the right to suspend or terminate these inclusions at any time. Membership inclusions can be viewed on the Website.
Gift vouchers are available for purchase from NUsport, University and NUsport, Harbourside.
Gift vouchers are partially redeemable. Within the validity period it can be used to make any number of separate purchases up to the value of the voucher, or above the value – in which case the recipient needs to make up the difference. Additional values cannot be added to an existing card; however, additional cards can be purchased. Gift vouchers are valid for a period of 3 years from the date of issue. Vouchers must be redeemed in full within the validity period; any unused balance will not be refunded or credited on expiry. Vouchers are to be treated like cash; defaced, mutilated, altered, lost or stolen vouchers will not be replaced, refunded or redeemed.
- Mates Rate eligibility is determined by NUsport at its sole discretion. NUsport may limit eligibility for membership purchase at any time.
